Radio Promotion Questioned

* RADIO 3PBS FM in St Kilda (Vic.) was receiving $3 from every voucher booklet sold in a promotion, covered in a Geelong Advertiser article headlined 'Ad Firm Caught In Phone Scam Fears'. MICHAEL HADE, of Brisbane-based Merchant Sampler Advertising, said his firm contacted about 5000 homes a day, offering a booklet containing $5500 worth of free food, entertainment, services and gifts. Consumers pay $88 for the book. KYLIE OLIVER, of The Geelong Advertiser, says several local readers were alarmed at the company's telemarketing, in which they were said to have been told they had been selected to 'win' the groceries. The Geelong News suburban paper, also published by COLIN DUCK, was mentioned in a call: 'A South Geelong resident - who lives alone - said a caller claiming to represent The Geelong News had phoned her on Wednesday evening to say she had won a competition in the newspaper.'

* NATASHA MULLER of Merchant Sampler Advertising said 'all its staff signed an agreement to stick to a prepared script and were instructed to speak in a slow, clear manner'. The company says it has 'suffered lost business and grief because people were now unfairly sceptical of the offer'.

News 'Reeling': South Sydney Decision

* JOHN HARTIGAN, Chief Executive Officer of News Limited, says his company 'did not set out to target Souths or any particular club' when it, as a National Rugby League 50 per cent partner, excluded the South Sydney club from the League. Headline writers for The Australian Financial Review Weekend Edition said RUPERT MURDOCH'S company was 'reeling' from the Federal Court 2-1 Full Bench judgement that the club was wrongly excluded from a streamlined 14-team competition. ANNABEL HEPWORTH and BERNARD O'RIORDAN of The Fin report that Seven Network boss KERRY STOKES will honour a $3 million sponsorship pldege, made through his Australian Capital Equity business. ROY MASTERS of The Sydney Morning Herald lists the STOKES generosity at $1 million. The Fairfax paper also has an extra dig at MURDOCH: 'In a further blow for the NRL and News Ltd, damages could be awarded to Souths when the matter goes back to the trial judge for an assessment of the club's losses'.

* NEIL CHENOWETH, who could be excused as being regarded as The Fin's correspondent with a weekly anti-MURDOCH instalment, wrote that it would have been the News Ltd executive 'wearing the asbestos clothing' who had the job of telling RUPERT about Friday's Court judgement. 'One can summarise News Ltd's version of Super League history under the heading 'It Wasn't LACHLAN'S Fault. There is a lot of truth in this. LACHLAN (MURDOCH) was just 23 years old, and some five months into his first job, at that first confused meeting, where the players managed to sign the wrong pieces of paper. But the pressure to find culprits for Super League, and the ascension of LACHLAN, has seen the departure of News Ltd's long-time chief KEN COWLEY and his natural successor, BOB MUSCAT. ROD EDDINGTON was supposed to run News after LACHLAN went to New York. His departure left PETER MACOURT as the only senior News Ltd executive with significant financial and business expertise ... The court decision on Friday puts MACOURT in the spotlight again ...'

* PETER MACOURT has been appointed Chief Operating Officer for News Ltd. A statement in Saturday's Adelaide Advertiser said: 'MR MACOURT, who joined the company in 1983, is a former Chief Financial Officer. He became Deputy Chief Executive in 1998.

* 'MALCOLM NOAD, who began his career with News Ltd in its advertising department in 1973, has been appointed Managing Director of Nationwide News, publisher of The Australian, The Daily Telegraph and The Sunday Telegraph. He will also chair the new consumer contact service News-Advantage.

* 'JERRY HARRIS, a former advertising sales executive with Times Newspapers in London, will become Managing Director of Queensland Newspapers. MR HARRIS, who moved to Australia in 1991, was previously Managing Director of News Ltd unit MAPT.'

* FLEUR BROWN, Broadcast Communications Manager of the Seven Network, writes: 'Dear Ash, In response to your story on the Community TV/Ashes issue (Media Flash Confidential, Wed., July 4), your readers may care to know that Seven is also disappointed that community television coverage of the first session of the Ashes cannot proceed in Melbourne, Brisbane and Sydney markets. We are pleased that coverage can still proceed in Adelaide and Perth - which we have worked very hard to achieve over the last few weeks.

* 'SEVEN has tried for a number of months to secure a free-to-air television partner to cover the first session of the Ashes. When ABC & SBS declined this offer, we put the opportunity to commercial television stations in Perth, Adelaide, Sydney, Melbourne and Brisbane. Unfortunately, we hit a legal snag with this on late Monday afternoon. Seven received external legal advice that we were in potential breach of the Trade Practices Act if we provided broadcast rights in markets covered by pay TV station, C7. This is because the words 'exclusive coverage' were used in an Optus program guide, in reference to the C7 broadcast. (in other words, new C7 subscribers may have signed up based on an expectation that the first session of the Ashes would be shown exclusively on C7).

* 'SEVEN has used its best endeavours to get this partnership to move ahead in Sydney, Brisbane and Melbourne. In fact, our technical people were working right up until Monday afternoon to assist community stations to resolve any technical issues in each state.'
