The public will now be left wondering whether there is one law for Prime Ministers and another for everyone else, ACT leader Richard Prebble says.

"The Chief Justice recently ruled that Constable Abbott's case must be referred to a jury, even though JPs had said they thought no jury would convict him.

"Today's decision leaves the way open for a private prosecution against Helen Clark. If a member of the public does bring a private prosecution, it clearly should be referred to a jury," Mr Prebble said.
