Pleased by Appeal Court Judgment
Mayor Peter Tennent
is pleased but unsurprised by today’s judgment of the
Court of Appeal that New Plymouth District Council’s March
2004 decision concerning 146ha of leasehold land in Waitara
was lawful.
Mayor Tennent says: “We are pleased to finally have clarity on this long running issue.
“We support everyone’s right to dispute council decisions and naturally we will defend these decisions when we feel they are in the community’s best interests.
“The appeal court’s judgment is timely as it coincides with the claims of individual Waitara leaseholders being heard in the New Plymouth High Court today. We hope these claims will also be resolved shortly.”
Mayor Tennent confirmed that the council would be seeking costs in the High Court from the respondent in the case - the Waitara Leaseholders Association - in order to minimise the ratepayer burden of legal expenses associated with the proceedings.
