Tena koutou the City is Ours Incorporated,
As you are aware, I went onto the intersection of Manners Street and Victoria Street on 22 June 2010 to undertake half an hour of emergency action. The action put my liberty as the collateral to challenge the developing project to put buses through Manners Mall. I have laid a claim of right to pedestrian and public safety knowing my actions to be lawful.
At 2.15pm on 10 August 2010 I have a pre-trail hearing of this matter in the Wellington District Court. I write to you advising that I will then seek a summary judgment that the Wellington City Council approved construction plans of the intersection require the bus lanes to be narrower than the legal requirements for the buses to be used.
The fact will clearly disprove evidence given by both Mana Coach Services and Opus International Consultants in the April 2010, Environment Court proceedings.
It is on this information that I suggest the City is Ours Incorporated engages a lawyer, and considers lodging an out of time appeal on the Environment Court decision of 15 April 2010.
