Clarification: 61 Molesworth Street

At the National Crisis Management Centre press conference today, a spokesperson stated MBIE has no investigations focussed on the property located at 61 Molesworth Street.

While there is no MBIE investigation into the structural issues, MBIE is investigating whether the property was being used for residential purposes unlawfully.

National Manager Compliance and Investigation (Tenancy Services) Steve Watson has provided the following statement regarding their investigation:

“MBIE’s Tenancy Compliance and Investigation team are currently investigating the allegation that 61 Molesworth Street was being used for residential purposes unlawfully. As this matter is currently under investigation, it would be inappropriate to comment on what the outcome of the investigation may be,” says Mr Watson.

‘Residential landlords are obliged to comply with all requirements in respect of buildings, health and safety made under any enactment as far as they apply to the premises. Renting out unconsented buildings, or buildings not consented for residential purposes, to people to live in, to use as their homes, raises serious health and safety concerns and is a breach of landlords responsibilities.

‘Landlords are running a business and they have an obligation to get it right. Landlords need to ensure they are proving, warm, dry, safe and legal home to people. We would encourage anyone who was living in 61 Molesworth Street to contact Tenancy Services on 0800 TENANCY to discuss their situation and options with us.

‘MBIE’s Tenancy Compliance and Investigation team investigates possible breaches of the Residential Tenancies Act. Landlords who exploit their tenants are breaching New Zealand law and will be subject to enforcement action,” says Mr Watson.
