Michael Hill Jeweller Limited Pleads Guilty

MEDIA STATEMENT - 6 SEPTEMBER 2000

Today in the Whangarei District Court, Michael Hill Jeweller Limited pleaded guilty to one charge of breaching s19(1)(b) of the Fair Trading Act 1986.

The company inadvertently breached the Act by advertising for supply on its website, a watch at a specified price when it did not have reasonable grounds for believing that the watch could be supplied.

Michael Hill Jeweller Limited General Manager, Kevin Phillips said the company regretted the mistake and in the circumstances, the nominal fine imposed was appropriate.

"The offence arose as a result of a genuine administrative oversight. There was no intent on the part of the company to breach the Act. Once the Commerce Commission made us aware of our technical breach [of the Act], we swiftly amended our website to comply.

"Michael Hill Jeweller is a reputable company that has never before faced charges under the Fair Trading Act. We believe strongly in the principles of the Act and intend to comply fully in the future, " Mr Phillips said.
