Campaign Launched Seeking Repeal of Employment Relations Amendment Bill Part 6a

Today marks the launch of a highly vocal and public campaign including the website www.part6a.org.nz to show the Government that Part 6A of the Employment Relations Amendment Bill is unworkable and should be repealed.

“With the $30billion franchise industry now at risk as a result of proposed amendments to Part 6A of the Employment Relations Amendment Bill, the Government really needs to take notice and finally kick into touch Part 6A,” says Grant McLauchlan, Managing Director of Crest Clean.

Companies like Air New Zealand, Progressive Enterprises, Transfield Services, the EMA, OCS, Spotless Services alongside organisations such as Business New Zealand, Hospitality New Zealand and the Franchise Association of New Zealand have all expressed difficulties in submissions to Government with Part 6A and there is a large desire to see this part of the Act repealed.

Mr McLauchlan says Part 6A problems include;

Denying businesses the freedom of choosing who enters and cleans their premises

The transfer provisions in Part 6A force businesses to employ people they wouldn’t normally employ

Part 6A obligations conflict with the Governments Health & Safety guidelines and legislation

Part 6A impacts on the tendering process by removing any competitive advantage through using innovations and training because employees elect to transfer on an ‘as is’ basis.

“Part 6A has proved totally unworkable and destructive to New Zealand’s commercial cleaning industry and has seen poorly performing companies protected and up-and-coming companies denied opportunities,” said Mr McLauchlan.

“The launch of the www.part6A.org.nz website encourages people to send their views to the Government as well as showing people how Part 6A is negatively impacting on both employers and employees.

The people most affected by this legislation are the customer and they have never been consulted.

“MPs need to recognise that their decisions on this Bill have very real implications on businesses, customers and employees and need to see a different view than that being pushed by the unions,” Mr McLauchlan said.
