Fair trial for Bain a virtual impossibility

The Green Party is questioning whether David Bain would be able to get a fair trial following the decision by Crown Law today to retry the case.

"It seems doubtful that he could get a fair trial after all this time and public interest. Everyone in New Zealand knows about the case and just about everyone has an opinion on it," Green Party Justice Spokesperson Nandor Tanczos says.

"These murders happened in 1994. The Bain house is long gone, as are some of the witnesses and those that remain are relying on memories of events that happened many years ago.

"Given that almost every New Zealander seems to have an opinion over whether or not he did it, selecting an impartial jury will be virtually impossible," Nandor says.
