The
trial Judge reserved a question of law relating to the
offence of “claim of right”. The question was reserved
pursuant to s 380 of the Crimes Act 1961. This is the only
mechanism which permits a Crown appeal following an
acquittal. The Crown will now consider the Judge’s rulings
and directions and decide if it is appropriate to pursue an
appeal. There will be no further comment from the Crown in
the
interim.
