SUBJECT: UPDATE ON JAILED AMCIT NGUYEN QUOC QUAN

1.(SBU) In an April 19 meeting with Vietnamese Ministry of Public
Security (MPS) Deputy Director General To Lam (septel), DCM raised
the status of imprisoned Amcit activist and alleged Viet Tan member
Nguyen Quoc Quan. Lam reported that Quan is out of the MPS
investigation stage, and his case is now with the prosecutor, who is
"validating" the case for arrest and trial made by the police.

2.(SBU) Lam said that no family visits are allowed in this stage,
and he said he could not guess how long it will last. Lam confirmed
that the charge will be related to Quan's alleged use of a false
identity document to enter the country rather than political charges
under article 88 of the GVN criminal code, "spreading propaganda
against the State."

3. (U) ConGen HCMC's last consular access visit with Nguyen Quoc
Quan was on February 20. Both Embassy Hanoi and ConGen HCMC have
repeatedly requested consular access visits since then and have yet
to receive approval.

4. (U) This cable was coordinated with ConGen HCMC.
