Giving clarity to Canterbury home owners: Canterbury Property Boundaries and Related Matters Bill

Parliament is looking at legislation that would help determine property boundaries in greater Christchurch. The Local Government and Environment Committee would like to hear from homeowners and others affected by the Canterbury Property Boundaries and Related Matters Bill.

A number of properties in greater Christchurch were affected by land movement following the earthquakes of 2010 and 2011. In some cases, it has been difficult for surveyors to locate physical evidence of boundaries, particularly under the current understanding where legal property boundaries are fixed except in the case of gradual and imperceptible water boundary movement. This has created uncertainty for surveyors and property owners.

The Bill hopes to address this problem by providing that legal boundaries of land in greater Christchurch have moved following land movement caused by the Canterbury quakes.

Chair of the Local Government and Environment Committee, Scott Simpson MP, believes that “this Bill hopes to provide certainty for homeowners, securing their property rights and ensuring property boundaries are clearly determined.”

The Local Government and Environment Committee is asking for public feedback up until 15 January 2016 and will report its findings in May next year.
