Brian Hill objects to probationary classification
Auckland City Council Regulatory and Fixtures Subcommittee today (20 January 2004) heard submissions from Mr Brian Hill who is objecting to his classification under section 22 of the Dog Control Act 1996 as a probationary dog owner.
The decision to classify Mr Hill was made by the Auckland City Animal Control Subcommittee in December 2003 following a conviction under section 58(a) of the Act for which he was sentenced to two months imprisonment for owning the dog that seriously injured Carolina Anderson in an attack at Cox’s Bay Reserve earlier in the year.
As a probationary owner, Mr Hill is not able to be a registered owner of any dog, unless he was the registered owner of that dog on the date of the offence, until January 2005 – two years from the time of the attack on Miss Anderson.
Councillor Juliet Yates, Chairperson of the Regulatory and Fixtures Subcommittee says, “Mr Hill will be notified in writing of the Subcommittee’s decision on his appeal in due course. If the classification stands, he will not be able to own a dog until the end of his probationary period.”
