Council resolution: horticultural soils
The Auckland City Council tonight passed the following resolution relating to horticultural soils.
“That the council:
Not place information on LIM reports regarding former horticultural land (except where investigation has shown the actual presence of contaminants constituting a risk to human health or the environment) except where a LIM report on a particular site is specifically requested, until the Crown Law office opinion is received.
From 26 November 2004 where a site specific request is made for a LIM on former horticultural land, the LIM and accompanying information be modified to more fully explain the background to this issue and make it absolutely clear that there exists no evidence of contamination on that site (except where investigation has shown the actual presence of contaminants constituting a risk to human health or the environment).
If the Crown Law office opinion identifies difficulties with the current legislation, the Council advocate for a law change such that information on potentially contaminated land is only included on LIMs where there is a high probability that contamination levels above recommended guidelines exist on a site.”
