Judicial Review Highlights Flaws Of Monte Cecilia Decision
City Vision acknowledges the granting of an interim order in the HIgh Court putting a stay to the decision of the Puketāpapa Local Board to remove the off-leash area in the bowl. This order follows a lodging by the Dog Lovers Society of a judicial review of the Puketāpapa Local Boards decision to remove the off-leash area in Monte Cecilia Park.
“We have had clear advice from staff not to remove the off-leash area, and I had offered a solution last month with a Notice of Motion to rescind the decision while the board worked on a masterplan for the park,” says Jon Turner, current Puketapapa Local Board member.
“It is really unfortunate that it has come to this stage, requiring hours of volunteer time and substantial financial input from residents, as well as substantial legal costs for Council.”
“Communities and Residents members ran on a platform of listening to the community, yet they have twice disregarded overwhelming public sentiment and clear staff advice.”
