US Questions NZ on Zespri at WTO

The US is raising questions regarding monopoly kiwifruit exporter, Zespri at the World Trade Organisation. A copy of the question lodged by the US delegation is attached. The question asks:

"With respect to Section III.C of notification G/STR/N/12/NZL, concerning New Zealand's STE for kiwifruit, we request that New Zealand please provide information on why it is that a key player in the NZ kiwifruit industry had to file legal proceedings in relation to collaborative marketing arrangements. Additionally, we request that New Zealand please expand on the court documents alleging anti-competitive behavior and abuse of Zespri's dominant position."

The case being referred to at the WTO is before the High Court and has been brought by leading New Zealand fresh produce company, Turners & Growers. Copies of the statement of claim are available at www.turnersandgrowers.com.
