1. Post is transmitting to Washington the communication received
from the Brazilian Foreign Ministry on July 12, 2006, providing the
United States with their comments on the suggested Portuguese
language text for the Cooperation on Environmental Scientific
Research in the Large Scale Biosphere-Atmosphere Experiment in
Amazonia Agreement(LBA).

2. Normally, Post would translate into English before sending the
cable, but since it is the exact Portuguese translation of the
agreed English text that is the issue, Post prefers to transmit
exactly as received for Department language division analysis.

3. The Diplomatic Note, dated July 11, 2006, from the Ministry of
Foreign Affairs is as follows:

"O Ministerio das Relacoes Exteriores cumprimenta a Embaixada dos
Estados Unidos da America e, com referencia a Nota Verbal no. 171,
de 23 de junho de 2006, tem a honra de responder as sugestoes
propostas pela parte norte-americana a versao em lingua portuguesa
do Ajuste Complementar entre o Governo da Republica Federativa do
Brasil e o Governo dos Estados Unidos da America para Cooperacao na
Area de Pesquisa Cientifica Ambiental do Experimento de Grande
Escala da Biosfera-Atmosfera da Amazonia (LBA).

2) No tocante a sugestao de alterar o termo Ajuste Complementar,
que esta presente ao longo de todo o texto, por Ajuste de
Implementacao, cumpre observar o estabelecido no paragrafo 2 do
Artigo 1 do Acordo de Cooperacao em Ciencia e Tecnologia, celebrado
entre a Republica Federativa do Brasil e os Estados Unidos da
America, que estabelece a designacao de ajustes complementares para
os acordos que regularem a execucao de atividades especificas de
cooperacao entre os dois paises. Tendo em conta que o LBA esta
inserido no ambito do Acordo de Cooperacao em Ciencia e Tecnologia,
o Governo brasileiro entende que o termo Ajuste Complementar
corresponde a nomenclatura adequada em lingua portuguesa. Acresce
que o termo Ajuste Complementar e a nomenclatura usualmente
utilizada pelo Governo brasileiro para Ajustes internacionais dessa
natureza.

3) No Artigo 4, o Governo brasileiro favorece a manutencao da
nomenclatura do Comite Cientifico Internacional (LBA - Scientific
Steering Committee - SCC).

4) Quanto as demais sugestoes propostas na Nota Verbal de
referencia, o Governo brasileira aceita:
nos consideranda, a alteracao do titulo do Acordo de Cooperacao em
Ciencia e Tecnologia;
no Artigo 3, alinea a, a alteracao do termo produtos por bens e, na
alinea f do mesmo artigo, a alteracao do termo especializados por
cientificos;
no Artigo 8, item 8, a inclusao da expressao do LBA; no item 3 e sem
custo adicional alem daqueles necessarios para atender ao pedido e,
no item 5, sem pagamento de quaisquer direitos autorais;
a supressao, no item 5 do Artigo 8, do termo livres;
no Artigo 11, a alteracao da palavra produtos por bens, no titulo e
nos itens 1 e 2, e a inclusao das palavras marcados e previa no item
3;
a alteracao proposta para o titulo do Artigo 12, que passa a ser
lido como Riscos e Responsabilidade; e
a inclusao da palavra consecutivos no, item 1 do Artigo 14."

4. Please let us know if this Portuguese language version of the LBA
is acceptable.
