1. Summary: Taiwan Civil Aeronautics Administration (CAA) informed
AIT/T that it had fined Chen Hsiao Ming (Docket Number 3157797)
NT$80,000 (US$2,500). End summary

2. In a letter dated September 4, 2006, CAA Flight Standards
Division Director Lee Wan-lee informed AIT/T of the final
disposition of the FAA violation case involving Chen Hsiao Ming --
EIR No. 2006 EA 150035. Chen was captain of China Airlines flight
11, which failed to comply with ATC departure clearance from JFK on
February 26, 2006.

3. CAA's investigation found that Chen violated Articles 41 and 41-1
of Taiwan's Civil Aviation Act; Articles 75 and 140 of the Aircraft
Flight Operation Regulations; and Articles 9, 47, and 49 of the
Flight and ATC Regulations. The investigation also found that the
flight's first officer, Wang Wen-chih, violated Articles 41 and 41-1
of the Civil Aviation Act; Article 75 of the Aircraft Flight
Operation Regulations; and Articles 9, 47, and 49 of the Flight and
ATC Regulations.

4. Based on Articles 111.1.1, 111.1.4 and 112-1 of the Civil
Aviation Act, CAA fined Chen Hsiao-ming NT$80,000 (about US$2,500)
and Wang Wen-chih NT$60,000 (about USD$1,875). In addition, China
Airlines issued a warning letter to each of them as a punitive
action.

5. AIT/T will forward an electronic copy of the letter to EAP/TC.
