1. This is an Action Request. See paragraphs 2-4.
2. The Department's Office of Defense Trade Controls
Compliance (PM/DTCC) requests Embassy's assistance in
conducting a post-shipment check on license 050101261 for the
export of military radios to Poland. PM/DDTC outreach team
plans to complete this check in conjunction with Embassy
during its visit to Poland on September 10 and 11.
3. Reason for request: WB Electronics, unfamiliar foreign
consignee.
4. ACTION: Embassy and PM/DDTC team is requested to make
inquiries with appropriate Polish Army and WB Electronics
officials to determine if it received 108 units shipped from
the U.S. on July 24, 2008 and that radios are being used for
purpose stated on license. Polish Army POC is M. Yzewczyk;
reference DSP-83 Nontransfer and Use Certificate signed on
April 4, 2008. Department requests that team conduct a site
visit to WB Electronics in order to assess its business
operations, on-site security, and general reliability as a
recipient of United States Munitions List (USML) items. POC
is Piotr Wojciechowski, Chairman, TEL: 48-22-731-25-51;
reference Purchase Order # 84v3/2008 signed on April 17,
2008. The following questions are offered as suggested
guidance with WB Electronics:
- Can the company provide documentation from the Polish Army
(e.g. purchase order, contract, or letter of intent)
establishing it as the final end user of these items?
- Does the company understand the restrictions on United
States Munitions List (USML) articles, particularly regarding
re-export and retransfer?
- What is the company's exact role in this transaction?
- Who are the company's main clients?
