1. (SBU) The UK agrees with the U.S. fully on the
substantive issues involving the Serbian proposal to refer
the question of Kosovo's declaration of independence to the
International Court of Justice (ICJ) (reftel). According to
FCO Balkans Office Deputy Head Adam Bye, the resolution is
"undesirable," will detract from stability, and possibly open
up wider issues that some wider UN members states might not
want aired.

2. (SBU) That said, however, Bye noted that HMG had not yet
reached a final position on how U.K. is likely to vote on the
resolution at the UN. The UK needs to balance showing
support for Kosovo against the potentially undesirable
effects of breaking EU consensus. According to Bye, HMG
wouldn't want to vote against the resolution just to find it
had generated more EU votes in favor. FCO Balkans Office
Head David Landsman intends to discuss these issues with DAS
Stu Jones in Washington during his vist the week of October 6.
