1. Post ESTH office received on behalf of EPA, a letter dated 10
February, 2010 from Secretaria de Medio Ambiente y Recursos
Naturales (SEMARNAT), concerning the exportation of hazardous waste
from the following United States companies to Mexico:

- Technologies Displays Americas, LLC.

2. The basic information in this letter from Alfonso Flores
Ramirez, Director General, division for the management of hazardous
waste is as follows:

In reference to your letter dated November 10, 2009, received in
this office with document number DGGIMAR-05073/0911 received on
November 18, 2009, and in reference to the Export of Hazardous
Waste Notification with number 19/2009, through which the company
TECHNOLOGIES DISPLAYS AMERICAS, LLC requests authorization for the
export of 144,000,000 Kg of cathode ray tubes (TRC) with
destination to the company TECHNOLOGIES DISPLAYS MEXICANA, S.A. DE
C.V., located in Mexicali, Baja California, during the period of
January 1 - December 31, 2010.

I would like to inform that this Directorate does not grant its
consent to the transborder actions being executed in accordance
with Export Notifications above mentioned.

The reason for this denial is that the company TECHNOLOGIES
DISPLAYS MEXICANA, S.A. DE C.V., of Mexicali, Baja California, does
not possess authorization to recycle hazardous waste in accordance
with Article 50 of the General Law for the Prevention & Integral
Processing of Hazardous Waste (LGPGIR) nor does it possess
authorization for the import of hazardous waste in accordance with
Articles 50, 85, 86, 89, 90 and 91 of the General Law for the
Prevention & Integral Processing of Hazardous Waste (LGPGIR) and
Articles 107, 108, 114, 116 and 118 of the LGPGIR Regulation.

I avail myself of this opportunity to renew the assurances of my
highest consideration.
