Communist Party Official Indicted by Spanish National Court

Visiting Senior Chinese Communist Party Official JIA Qing Lin Indicted by Spanish National Court on Charges of Genocide and Torture of Falun Gong Practitioners

JIA Qing Lin, Chairman, National Committee of the Chinese People’s Political Consultative Conference is currently visiting New Zealand in his official capacity. JIA, the fourth most powerful Chinese Communist Party member, is complicit in the persecution of Falun Gong practitioners in China. Since the beginning of that persecution in July 1999, JIA has frequently expressed support for and encouraged the persecution of Falun Gong practitioners and his actions do therefore amount to incitement.

In November 2009, the Spanish National Court indicted JIA Qing Lin, Jiang Zemin, Luo Gan, Bo Xilai and Lu Guanzheng,as the five chief perpetrators of the persecution of Falun Gong, charging them with crimes of genocide and torture.

The Spanish National Court made the decision based on the Universal Jurisdiction of International Law. Universal Jurisdiction applies to crimes of genocide, crimes against humanity, war crimes and crimes of aggression. Once the ruling is issued, it has the permanent effect of law.

For this principle to have applied, the crimes of JIA Qing Lin and the other CCP officials were found to be extremely severe. As a result, any country can punish the defendants. Over a decade ago, the Spanish court asked Britain to extradite Pinochet, the former dictator of Chile.

This decision has opened the way for JIA Qinglin and others to be arrested by countries that have extradition agreements with Spain.
