The issue of judicial
activism isn’t going away anytime soon-that much is clear
following the most recent intemperate commentary from
Justice Sian Elias. Speaking at a recent Auckland
conference, Elias’ outburst concerned judges pay and their
early retirement age. It is an embarrassment for Helen Clark
and Michael Cullen every time judges open their mouth but
does that mean they shouldn’t? Bill Hodge of the Department
of Law at Auckland University is on the Wire this
afternoon.
