Solicitor-General Considers Taking Over Banks Prosecution

The Solicitor-General has confirmed that, following a judge's decision to commit MP and Act Party leader John Banks to trial, he is considering whether to take over the private prosecution.

The private prosecution was commenced by Graham McCready against Mr Banks for signing a false return for spending in his 2010 Auckland Mayoral campaign.

McCready v Banks: Request for Solicitor-General intervention

Our Ref: SOL115 / 2464

I refer to my letter of 25 June 2013 in which I advised that I would reconsider my decision not to intervene in the private prosecution of Mr Banks in the event there was a committal for trial.

In light of Mr Banks’ committal yesterday, I confirm I am reconsidering whether to take over conduct of the prosecution. I welcome any comment or information to assist me in making my decision. Given the applicable timeframes, in particular the time for filing of an indictment, please provide any comment by 25 October 2013.
