Peter Spencer continues Protest following 52 day Hunger Strike
As Peter Spencer recovers in hospital after ending his 52 day hunger strike he remains committed to continuing his protest. “My call on Mr. Rudd remains the same - establish a Royal Commission and pay the farmers, and if they think I am going to go away, they are wrong", said Peter Spencer.
Dr. Mike Kelly, Member for Eden-Monaro states that Peter Spencer has not followed Due Process. Please find below the letters which show that Spencer did in fact follow due process. The letters sent by Peter Spencer regarding this matter over the last 1½ years are listed below.

Dear Prime Minister,
The attached letter was sent to your predecessor, regrettably, no response from him, was forthcoming. As said in that letter I made a mistake voting for him. The lies and arrogance led me, for the first time, to vote for you. For me, as a farmer that was a big move.
I have noticed with interest,
your attempt over the last 100 days to address many issues
and source the views of the people. If you can take the time
to look into the attached, then I would be very grateful. I
am sure if you read the document, you will be repulsed by
its contents especially as you appear to be a man of
principle and I am certain you would be of the opinion we
live under the Rule of Law, as our Constitution provides.
In regard to the
substantive matter and the need for due process, I
have met with and written today to my local member, Dr Mike
Kelly MP, predominantly regarding carbon levels being –
130%. NOT 108% as reported in the past, to the
UNFCCC, that is if one removes the carbon deception from
Prime Minister Howard’s choreographed equation.
I have every confidence my local Member, Dr Kelly, will process my submission to him, through the appropriate channels and in due course address the issues raised in the submission, many of which are covered in the attached, Saarahnlee Entreatee.
As Prime Minister, I feel you would want to be informed of this matter, as I felt, mistakenly, the former Prime Minister would have been desirous of been so informed.. In this regard I was deeply disappointed..
I look forward to you being all you have said, on the record, what you want to be, now you are our Prime Minister. I am well aware morality, generally, has been in short supply for many, many years in politics and if you Sir can turn that around it will not only be most honourable but the people will be abundantly gracious in their response – and you will have in return, their very deep gratitude. To this end, I trust Prime Minister, you have girded your loins well, as I am sure, I have no need to tell you - your chosen sojourn, will not be an easy ride.
I, subsequently, wholesomely encourage you. I am pleased you are prepared to try. You have my support and most importantly, my prayers will be with you.

On Monday, November 23, 2009 before embarking on
his Hunger Strike Peter Spencer wrote a letter and submitted
a detailed document outlining his request to the Prime
Minister of Australia. Please find this letter below:

To the Prime Minister of Australia
Mr Kevin Rudd MP.
As you and your
Government have decided to refuse me my Constitutional
rights – see copy of letter attached below 2nd May 2008, I
now am intending to take my plea to the
people.
I have found your Ministers and
Members – the ones referred to in correspondence, entirely
immoral and as said in all my correspondence they have had
every opportunity to rectify the injustice against the
Australian Farmer/land owner. However they have refuse as
you have done to act morally and as the Australian
Constitution requires, as have the Courts and the Public
Service.
However, as the head of the
Australian Commonwealth Government, you must bear the burden
for the theft of the entire Kyoto emission target being Mt
– 87.5 CO2 – e. from the targeted
farmers.
It is now my role to tell the
world this is your standard of conduct – that is, you
steal the entire commitment to meet this International
treaty from your own people, being we the targeted
Australian Farmers referred to in this submission at
horrific cost and suffering to
us.
Subsequently, my adopted course of
action is as follows and once again I point out my response
as presented here is entirely due to your failed response to
our numerous pleas for justice on Just Terms and your
deliberate cover up and deception of the entire
expropriation of our assets.
I am now
retiring to my property Saarahnlee and I will scale a 300
foot Wind Monitoring mast on the main cordillera of the
property which is – the cordillera, a mile high. The Tower
is located between the Mountain of Flinders and Roberts. I
will remain there until that which I seek is agreed
to.
I will ask the Australian People
– those that have all the rights to this democracy NOT the
mere servants of those people – as they those servants
have proven they are not worthy to be given that trust – I
will ask the people if I we the farmers are entitle to our
constitutional rights in payment and by so receiving that
payment enable Australia to meet its International treaty
obligations in good faith and as a civilised State that does
not steal its citizens property breaking even the most basic
of human rights.
I will not
be eating for the time on the Mast and I will not leave the
Mast until the terms are met – there is no compromise, no
negotiation and no discussion.
I
have tried the protocol of being reasonable for 10 years.
That opportunity has passed.
In the
event my terms are agreed (See Terms as set out in the in
Attachment – Actual Claims to the prime Minister)
– that is the Government has agreed to behave
Constitutionally, then I require a committee be established
immediately to ensure the items raised here are all provided
to totally fulfil to the detail all the matters raised here.
The committee will require the funding of a commission of
enquiry and these persons names are to be found in a signed
letter at Saarahnlee if needed.
The
role of the committee will include the terms of reference
for the Royal Commission and the agreement of the
appointment Commissioners to be appointed and all demands
and all aspects of the payments in this document including
the timing deadlines.
Further the
committee’s brief is to include any other matters that the
committee see as necessary to carry out there
responsibly.
As you prepare for
Copenhagen think of us the Australians who paid the entire
Carbon tab while you rewarded the polluters the power
stations and the coal industries and lied to the people
about our role….
Please do not lie in
Copenhagen tell the world how you achieved your targets and
the fact you stole your achievement.
I
beg you to show the world this submission and attachments
and see if they applaud you as the white knight of global
warming as I will be placing it on the web and in the hands
of the global media.

Attached to the letter Spencer wrote to PM Rudd in November was a copy of his previous letter dated May, 2008. Both were sent via member Dr. Kelly, which his office confirmed via email. Included with the letter was a full submission to the Prime Minister which had also been sent to the former Prime Minister, Mr. Howard. The full submission referred specifically to the substantive matter being the fact that UNFCCC figures relating to the entire tonnage of carbon used to meet the Kyoto Commitment have been stolen from farmers. This is also referred to in paragraph 3 of the letter dated May 2008.
Receipt of the submission was confirmed by member Dr. Kelly’s office. According to due process it was expected that the submissions would be directed by Dr. Kelly to the portfolio of Minister Wong and further submitted to PM Rudd. Wongs’ response along with the PM’s response should have been returned to Spencer by member Dr. Kelly. Subsequent follow-up enquiries to both letters failed to obtain any response. So in fact it is member Dr. Kelly and the Government that have failed to follow due process, not Spencer.
On January 17, 2009 Spencer states that “the
Australian Government has still not responded to any of
these documents, Dr. Kelly had 18 months to respond to me
before I started my hunger strike, I am yet to receive a
response regarding his carriage of my submissions to Wong
and the Prime Minister.”
Due process has been followed
by Peter Spencer and Dr. Kelly was involved in this process
from the beginning.
