Peter Spencer represented by barrister Peter King will appear before the Full Bench of the High Court, Canberra on Wednesday 16th June for the hearing of Spencer’s application for leave to appeal the carbon case - Spencer vs. the Commonwealth.
Ranged against Spencer and King will be the full might of legal teams assembled at massive cost by the Commonwealth and State Governments to argue the case for the Governments implicated in the case. On Peter Spencer’s side – the majority of the legal research is carried out by Peter Spencer and a small team of unpaid supporters; nevertheless it is this small largely volunteer legal team that has achieved the breakthrough of being granted this hearing before the Full Bench against the might of the Commonwealth.
In addition, Spencer has significantly gained the support of two key agricultural peak bodies:
• The National Farmers Federation through its
AFFF fund is providing substantial funding to support
Spencer’s case; and
• The NSW Farmers Association is
going to intervene in the hearing with a supporting
submission.
Peter has also significantly obtained the support of Professor Richard Epstein for the case. Richard Epstein is a professor of law at New York University and a senior fellow at the Hoover Institution and the University of Chicago. He is renowned as the author of Takings: Private Property under the Power of Eminent Domain (Harvard University Press, 1985), which sets out a comprehensive theory of permissible vs. impermissible taking of private property for public use, and the inconsistency arising from narrow interpretation of such takings without just compensation. Professor Epstein has contributed to and prepared parts of the documentation which has already been submitted to the Full Bench and which barrister Peter King will be presenting.
WHEN: Wednesday 16th – Thursday 17th June, 2010
TIME: From 12:30 PM Wednesday – supporters meeting, court hearing commences at 2:00 PM
WHERE: Meeting point will be Magna Carta Place, Queen Victoria Terrace, Canberra. At 1:00 PM, supporters will walk to the High Court to support Peter Spencer and Peter King.
WHY: There is more and more interest in this case in legal and political circles as people recognize the justice of Spencer’s case and that this is a test case for thousands of farmers similarly affected by unfair Commonwealth sponsored native vegetation legislation. Neither has Peter Spencer backed away from his call for a Royal Commission into how the farmers land was used to meet the Government’s commitments under the Kyoto international treaty, and for full payment to the farmers that have provided this benefit to the Commonwealth. Spencer said “These demands will not be withdrawn, and this immorality and abuse of rural Australia will be an issue laid before the Australian people in the upcoming State and Federal elections, asking them to choose very carefully.”
