ACT Police spokesman Ken Shirley says Police Commissioner Peter Doone should stand down until cleared by the internal police enquiry into events on election night.

"It is wrong for Mr Doone to stay in office while his own assistant conducts the enquiry," Mr Shirley said. "Justice can't be seen to be done when the person being investigated is still the boss of the person conducting the enquiry.

"Moreover the timing of this internal enquiry could not be worse. With the festive season approaching, it is inappropriate for Commissioner Doone to remain in the job while drink driving issues relating to him remain unresolved.

"The enquiry must ask why the driver of the car was not breath tested and whether Commissioner Doone's intercession as a passenger stopped the constable from breath testing the driver," Mr Shirley said.

"With drink driving an issue in the festive season, the public has the right to expect a totally impartial investigation into an incident involving alcohol, driving and the Commissioner of Police" Mr Shirley concluded.
