1 Campaign for a Better City Incorporated (CBC) has carefully evaluated its position following the award of costs against it by the High Court. Over the past three months CBC has undertaken a range of fundraising activities and also made clear the financial position of the society in communications with members and the general public.

2 The Committee of CBC has determined that at present CBC has no realistic prospect of raising funds to meet the debts owed by the society.

3 The Committee has resolved to invoke the winding up provisions of the society’s constitution. Under those provisions the wind up process will take three months.

4 CBC is constitutionally obliged to continue operating during the wind up period. CBC will not be undertaking any activities that incur unnecessary costs.

5 Any and all funds at winding up will be applied to the repayment of debt in the order prescribed in the Companies Act 1993. Following determination of the society’s final financial position at winding up, CBC will advise whether there will be any distribution to Transit New Zealand in respect of the costs order.
