Swimming Pool Fencing: Logistics Problem

A number of pool owners have been receiving letters from Warrick Brooks, Sundry Debtors, Waitakere City Council, advising that they have been, or are about to be, referred to debt collectors and "this action may affect your credit rating for the next 5 years."

This is despite the fact that since 1 October Council said it would review all cases (approximately 200).

On 1 December Denis Sheard, Legal Services Manager for Waitakere City Council, advised 193 cases had been reviewed and of those, 4 prosecutions had been withdrawn.

When queried about one of those specific cases he replied " It appears that I was misinformed. The new fencing to the ..... pool if not completed, is very close to completion, but has yet to receive the final tick. I am informed that a further inspection is due in the next day or so. Withdrawal will only occur when the new fence is complete."

When asked when the 193 cases who have been reviewed, will be informed of the outcome, his response was "In due course."

An enquiry to the Waitakere District Court on Friday 3 December revealed they have had no contact whatsoever on this matter since 1 October from WCC.

With approximately 200 cases set down for call-overs in February and March 2005, this poses a huge logistics problem.
