Corrections and the Department of Labour have had an understanding for many years that Corrections will only report injuries to prisoners to the regulator (now WorkSafe) when they are injured in the course of any employment or educational activities. Serco follows this lead.
Corrections has taken legal advice and does not consider that, under section 25 of the Health and Safety in Employment Act 1992, the Department has any obligation to report serious harm to prisoners caused by prisoner on prisoner assault or prisoner self harm to WorkSafe as they are not employees.
WorkSafe is aware that prisoners can be injured from assaults inside prison. Prisoner-on-prisoner assaults are managed internally by Corrections and the Police may investigate depending on the nature and seriousness of the assaults. This is decided on a case-by-case basis.
