Sexual Predator Shown Leniency by Judge

SEXUAL PREDATOR SHOWN LENIENCY BY JUDGE

24th September 2016

“Premeditated sexual offending against a child is as bad as it gets and must be punished with the harshest of prison terms” Scott Guthrie

A Wellington man, who forced his nine-year-old niece to watch pornography while repeatedly sexually assaulting her over a five-week period, will be eligible for parole in 27 months’ time.

The 30-year-old forced the child to watch pornography on his phone while he repeatedly sexually violated her and masturbated beside her.

“This offending is undeniably planned and premeditated. It will have a lasting damaging effect on the victim. Can Judge Davidson tell New Zealand what part of this sentence is a deterrent to the offender and what sort of message does it send to the community” Scott Guthrie

The man blamed stress and anxiety in his life for the offending and his probation report said he still declined responsibility for his offending.

"There is a sense that you were grooming her for more serious offending, she was only nine and she was extremely vulnerable." Judge Bruce Davidson Wellington District Court

Sensible Sentencing Trust’s National Spokesperson for child abuse Scott Guthrie says this type of offending is the worst of its kind. The real concern here is the sentence is clearly no deterrent for these offenders, because they know if they do get caught, there isn’t a Judge in New Zealand that will punish them to the full extent they can under the law.

“Here we have an offender who could have easily been sent to prison for well over 10 years but the system is set up to be offender friendly, with little to no consideration for the victim or public safety” Scott Guthrie

Sensible Sentencing Trust is looking to arrange a meeting with senior judges, to discuss what we believe are inadequate sentences, and to look at the way forward. END
