Have Your Say On The Trespass (Specified Retail Premises And Other Matters) Amendment Bill

The Chairperson of the Justice Committee has called for public submissions on the Trespass (Specified Retail Premises and Other Matters) Amendment Bill. It would amend the Trespass Act 1980 in response to recommendations from the Ministerial Advisory Group for the Victims of Retail Crime. The amendments aim to improve the Act’s effectiveness within a retail environment by giving retailers, food service providers, and licensed premises more tools to deter retail crime and keep their property, workers, and customers safe. The bill would:

  • increase to 3 years the maximum period during which a trespass warning could apply, with discretion for any period up to that maximum
  • create a new bespoke power for occupiers of retail, food service, and licensed premises (a specified retailer) to trespass a person from multiple locations at once
  • widen the circumstances in which a person could be considered to know that they had been trespassed from a location occupied by a specified retailer
  • create provisions for situations where an occupier of any premises did not, or could not, clearly inform the person of the period or location to which a trespass warning applied
  • increase the maximum monetary penalties for refusing to leave when directed to do so, breaching a trespass warning, and refusing to give a name and address when requested by an occupier.

Tell the Justice Committee what you think
