Unions fight back against the explosion of agency labour

IndustriALL Global Union released ‘The Triangular Trap’ today, 2 October, a new report attacking the massive expansion of the use of agency work and demanding direct, secure and decent employment.

“Employment via agencies, labour brokers, dispatchers and contractors is being used to wholesale replace permanent, direct employment. Its use goes way beyond any legitimate need to fill genuinely temporary vacancies,” said Jyrki Raina, General Secretary of IndustriALL Global Union.

Massive expansion
‘The Triangular Trap’ reports that the “according to the global agency industry body, the International Confederation of Private Employment Agencies (Ciett) (www.ciett.org/ ) the industry’s global annual sales revenue increased from €83 billion in 1996 to €203 billion in 2009 and the number of agency workers has more than doubled over the same period.”

The defining characteristic of agency labour is a triangular relationship between the user enterprise, the agency and the worker, isolating the worker from the enterprise that effectively controls their work, their pay and their conditions so that the worker has no say in any of them and has no mechanism to negotiate improvements.

The result is agency workers typically receive lower wages than directly hired workers performing the same work and they are excluded from numerous benefits and face higher health and safety risks. Agency workers are also typically unable to join a union or bargain collectively.

“Employers all over the world are taking advantage of laws which allow them to replace their permanent workforces with agency workers in order to avoid their employment obligations,” said Raina.

Industry lobbying to increase use of agency labour
The report exposes how agencies and Ciett gloss over the negative consequences of agency work in their lobbying efforts to remove legal restrictions on agency work. In a chapter on busting the myths put forward by Ciett, The Triangular Trap cites numerous examples from workers and unions around the world who are fighting against the negative impact of agency work.

IndustriALL is launching ‘The Triangular Trap’ as part of its global campaign to stop precarious work. On October 7, the World Day for Decent Work, IndustriALL affiliates will be mobilizing their members to take action against the spread of agency work and other forms of precarious employment.

“With ‘The Triangular Trap’ IndustriALL is sending a message to business and governments worldwide that we will not sit quietly while workers’ rights and the labour standards and protections that have been achieved through union struggle are undermined by agency work,” said Raina.

IndustriALL Global Union publie aujourd’hui, 2 octobre, ‘Le piège triangulaire’, un nouveau rapport qui s’attaque à l’expansion massive du recours à des agences de travail intérimaire, et préconise un emploi direct, sûr et décent.

“Les emplois obtenus auprès d’agences, de recruteurs, d’intermédiaires et d’entrepreneurs servent à remplacer, en bloc, des emplois permanents et directs. Le nombre de ces emplois est très supérieur aux besoins légitimes pour remplacer de véritables postes temporairement vacants”, affirme Jyrki Raina, secrétaire général de IndustriALL Global Union.

Expansion massive
‘Le piège triangulaire’ signale que “selon l’organe industriel mondial des agences de placement, la Confédération internationale des agences d’emploi privées (Ciett) (www.ciett.org/ ) les recettes provenant des ventes annuelles mondiales dans l’industrie ont augmenté, passant de 83 milliards d’euros en 1996 à 203 milliards en 2009, et le nombre d’emplois fournis par ces agences a plus que doublé durant la même période”.

La caractéristique particulière du travail fourni par ces agences est une relation de travail triangulaire entre l’utilisateur final, à savoir, l’entreprise, l’agence et le/la travailleur/euse, qui isole ce dernier de l’entreprise qui contrôle en réalité son travail, son salaire et ses conditions, ce qui fait que le/la travailleur/euse n’a pas voix au chapitre et ne dispose d’aucun mécanisme pour négocier des améliorations.

Il en résulte que le personnel intérimaire perçoit habituellement des salaires plus faibles que le personnel embauché directement, tout en faisant le même travail, sans avoir droit à de nombreuses prestations, et sans compter le fait qu’il fait face à des risques plus élevés de santé et de sécurité. Le personnel intérimaire embauché par des agences n’a pas généralement la possibilité de se syndiquer ou de négocier collectivement.

“Dans le monde entier, les employeurs tirent avantage d’une législation qui leur permet de remplacer leur main-d’œuvre permanente par du personnel intérimaire fourni par des agences, pour leur éviter de se soumettre aux obligations d’emploi”, affirme Raina.

L’industrie fait pression pour accroître le personnel intérimaire
Le rapport montre comment les agences et la Ciett passent sous silence les conséquences négatives du travail intérimaire dans leurs efforts pour éliminer les restrictions juridiques à cette forme d’emploi. Dans un chapitre visant à mettre fin aux mythes avancés par la Ciett, ‘Le piège triangulaire’ donne de nombreux exemples de salariés et de syndicats luttant partout dans le monde contre l’impact négatif des agences de travail intérimaire.

IndustriALL publie ‘Le piège triangulaire’ dans le cadre de sa campagne mondiale contre l’emploi précaire. Le 7 octobre, à l’occasion de la Journée mondiale pour le travail décent, les affiliés de IndustriALL vont mobiliser leurs membres pour engager une action contre le développement du travail intérimaire et les autres formes d’emploi précaire.

“Avec ‘Le piège triangulaire’, IndustriALL envoie un message aux entreprises et aux gouvernements du monde entier pour affirmer que nous ne resterons pas tranquille tant que les droits des travailleurs et travailleuses et les normes et protections du travail, obtenus par des luttes syndicales, se trouveront menacés par les agences de travail intérimaire”, affirme Raina.

La IndustriALL Global Union ha publicado hoy, 2 de octubre, ‘La trampa triangular’, un nuevo informe en el que se ataca la masiva expansión del uso del trabajo por agencia y en el que se demanda empleo directo, seguro y decente.

“El empleo a través de agencias, intermediarios laborales, cesionista de trabajadores y contratistas se está utilizando para sustituir con carácter general el empleo permanente y directo. Su uso va más allá de toda necesidad legítima de cubrir vacantes verdaderamente temporales”, dice Jyrki Raina, secretario general de la IndustriALL Global Union.

Expansión masiva
En ‘La trampa triangular’ se informa de que, según el organismo del sector de agencias mundiales, la Confederación Internacional de Agencias Empleo Privadas (Ciett) (www.ciett.org/ ), los ingresos de las ventas anuales mundiales del sector aumentaron de 83.000 millones € en 1966 a 203.000 millones € en 2009, y el número de trabajadores por agencia se duplicó con creces en el mismo período”.

La característica que define el trabajo por agencia es una relación triangular entre la empresa usuaria, la agencia y el trabajador, aislando a éste de la empresa que efectivamente controla su trabajo, su remuneración y sus condiciones, de manera que el trabajador no tiene nada que decir en ninguno de los casos, ni dispone de mecanismo alguno para negociar mejoras.

El resultado es que los trabajadores por agencia reciben normalmente salarios más bajos que los trabajadores contratados directamente que realizan la misma tarea y están excluidos de numerosas prestaciones, además de afrontar riesgos de salud y seguridad. Los trabajadores por agencia tampoco pueden normalmente unirse a un sindicato ni negociar colectivamente.

“Los empleadores se están aprovechando en todo el mundo de leyes que les permiten sustituir a sus trabajadores permanentes por trabajadores por agencia, a fin de eludir sus obligaciones de empleo”, dice Raina.

La industria ejerce presión para aumentar el uso del trabajo por agencia
En el informe se expone cómo las agencias y Ciett encubren las consecuencias negativas del trabajo por agencia en sus esfuerzos para eliminar restricciones legales sobre el trabajo por agencia. En un capítulo dedicado a acabar con los mitos expuestos por Ciett, en La trampa triangular se mencionan numerosos ejemplos de trabajadores y de sindicatos de todo el mundo que luchan contra el impacto negativo del trabajo por agencia.

La IndustriALL está lanzando ‘La trampa triangular’ como parte de su campaña mundial para detener el trabajo precario. El 7 de octubre, Jornada Mundial por el Trabajo Decente, los afiliados de la IndustriALL movilizarán a sus miembros para llevar a cabo acciones contra la extensión del trabajo por agencia y otras formas de empleo precario.

“Con ‘La trampa triangular’ la IndustriALL envía el mensaje a las empresas y a los gobiernos del mundo de que no permanecerá con los brazos cruzados mientras el trabajo por agencia socava los derechos de los trabajadores y las normas y protecciones laborales que se han logrado mediante la lucha sindical”, dice Raina.
