Swimming Pool Fencing: Dinosaurian Progress!

A couple of years ago Waitakere City Council embarked upon a very heavy-handed campaign against its pool owners. You're being unreasonable said the pool owners. Not so, said the Council "It's our job to enforce the law." That may be so, but WCC started marching its citizens off to Court because of what it wanted the law to say rather than what the law said. On 2 August 2004 the Council sought a declaratory judgment to reinforce its stance.

On ! October Judge Randerson rejected the declaration sought by Council. Things are under review pool owners were told. When will we be told the result said pool owners.

On 1 December I asked Denis Sheard, Legal Services Manager, how many cases had been reviewed and was told 193.

On 27 December I wrote to him asking how many of those people had been notified of the outcome.

On 10 January he replied "to date none, but letters will start to go out this week." --- A pretty poor show 3 and a half months after the event!

Oh, by the way, Waitakere City Council having issued 644 prosecution notices in less than 3 years under the old law is now lobbying Government to bring in a NEW LAW!!!
