The Heritage Area Act contains a number of references to the Resource Management Act. The Government is in the process of replacing the RMA through the Planning Bill and the Natural Heritage Bill without at this stage making the necessary changes to the Heritage Area Act.
The effect would be to make a significant part of the Heritage Area Act irrelevant and of no effect.
Consent applications would no longer have to take into account the objectives of the Heritage Area Act. Regional Spatial Plans and Land Use Plans could also ignore the protective measures contained in the Act. Death by a thousand cuts could again become a reality.
The Bill is to be reported back to Parliament on June 26. If changes are to be made before then urgent action will be required.
